Star agent Nocella received his termination letter on 3/1/18 and his attorney, Mr. DellUniversila, filed a complaint at the N.Y. Suffolk County Supreme Court on 3/10/18 and received an injunction/Temp Restraining Order from Judge Gaguilo on 3/15/18. The judge’s injunction order ceased the sale of his book and restored the use of telephones and computers by Nocella in his office “only to the extent necessitated for daily operation.” Whatever was mixed up in not serving the injunction properly on Allstate caused Nocella to be barred from his office, which could still be operated by his former staffs to serve his customers, in the amended injunction. His attorney amended his original complaint to add three officials of Allstate as a tortious complaint and successfully remanded the case back to the local supreme court, since Allstate had removed the case to the federal court. Allstate and the three of its officials faced a tortious damage claim of $18.75 million from Nocella in the supreme court of Suffolk, filings of which were not available to us now. We shall update the content, once available.
At the time of his termination, Allstate was allegedly only willing to pay him $98,325.74 as TPP for his economic interest of a $5.1 million book of business with super loss ratio and retention. (What a steal!) The market value of such a book was worth at least $1.6 million. Allstate gave him the deadline day of 7/1/18 to sell his book. He finally sold the book for $1.6 million on 8/15/18. His attorney’s speedy filing earned him additional 45 days to market his book to receive, in the end, a decent market value. (Good attorney does matter!)
