This lawsuit headed by the prominent constitution attorney Mr. Bopp, who said to Alexandra Garfinkle of P & C Specialist (5-24-21), “I want to win every case,” when he filed it at the federal court on 5-18-21, is quite peculiar in the following ways: First, he did a voluntary dismissal without a court hearing two months and ten days later (7-28-21) from the federal court. He then moved the trial to a lower court, the Circuit Court of the Cook County, filing the same complaint. Second, in the federal case he waived service, which means he gave the defendant Allstate 60 day instead of the normal 21 days to response to the complaint. It suggests the two parties were engaged in a settlement negotiation. It failed. Mr. Bopp would probably not win the federal case. He felt he had a better chance at the circuit court. Third, Mr. Bopp was contracted by National Association of Professional Allstate Agents, Inc. (“NAPAA”) around 9-20-20 and it had taken him about 8 months to work out an argument for an injunction on AAV (Allstate Agency Voice/Mandatory Usage of Allstate Telephone Systems) on behalf of NAPAA, which was denied by the Circuit Court Judge Roberts. His representation of four ex-agents as part of the Complaint is still underway. We shall in our blog further discuss in detail Mr. Bopp’s suit, whose aim might contrary to most agents’ wishes.
